Regulations concerning regular communal passenger transport carried out as part of Lublin's urban transport network

REGULATIONS CONCERNING REGULAR COMMUNAL PASSENGER TRANSPORT CARRIED OUT AS PART OF LUBLIN'S URBAN TRANSPORT NETWORK

§ 1
Regulations concerning regular communal passenger transport carried out as part of Lublin's urban transport network, within the framework of public transport, hereinafter referred to as “regulations”, are in force in Lublin urban transport lines, including the lines that are functioning on the basis of communal agreements.
§ 2
Whenever the resolution mentions:
1) The Organiser – it should be understood as the organiser of public transport within the meaning of the Act of 16 December 2010, on Public Transport (Journal of Laws of 13.05.2011, as amended), hereinafter referred to as the “Act on P.T.”;
2) The Operator – it should be understood as a public transport operator, as defined in the Act on P.T., that is an entrepreneur authorised to run a business in the field of passenger transport, who entered into agreements with the Organiser on the provision of public transport services within Lublin's urban transport lines;
3) The Carrier– it should be understood as a carrier, as defined in the Act on P.T., that is an entrepreneur authorised to run a business in the field of passenger transport on the basis of the confirmation of a transport notification;
4) The Inspector – it should be understood as a person authorised to conduct inspections by virtue of the Organiser’s authorisation;
5) The Passenger – it should be understood as a person that is being transported using the Operator’s vehicle.

I. The regulations concerning conduct inside a vehicle:

§ 3

The Passenger shall observe the regulations stipulated herein, as well as all applicable rules of the law.
§ 4

1. The Passenger shall be obliged to:
1) enter or exit the vehicle only at accordingly-marked Lublin urban transport bus stops, following the stopping of a vehicle and exercising maximum caution;
2) comply with notices and informational signs located within and outside the vehicle, and also with any instructions and requests of the driver;
3) give up his or her seat marked with a graphical sign “for a disabled person” or “for a person holding a child” to this eligible person.
2. Within vehicles, it shall be prohibited to:
1) drink alcohol, smoke tobacco or take any narcotic drugs;
2) consume foodstuffs that can result in soiling the clothes of other passengers or the vehicle;
3) soil or litter up the vehicle, destroy any equipment and furnishings of the vehicle, e.g. by painting of scratching;
4) throw out any items through the windows or doors of the vehicle;
5) lean out through the window or lean against the door of the vehicle during the ride;
6) enter and remain in the vehicle while wearing ice skates, roller blades, etc.;
7) disturb order in the vehicle by behaviour that runs against the rules of social coexistence or the utilisation of any equipment that can disturb order (e.g. through loud playing of music);
8) beg and peddle;
9) enter or exit the vehicle after the sound signal;
10) distribute and scatter leaflets and advertising materials without the consent of the Organiser (regarding Operators) or the Carrier;
11) run cultural, social actions, etc. without the consent of the Organiser (regarding Operators) or the Carrier.
II. Regulations applying to the Operator / Carrier:

§ 5

1. The driver and inspectors are authorised to prevent the transportation of persons that are threatening the safety and order of transport, disturb the order in the vehicle or are otherwise troublesome to other passengers, especially of persons whose condition suggest being under the influence of alcohol or narcotic drugs, or of aggressive persons. The driver and controllers are also authorised to instruct such persons to exit the vehicle. Such persons shall not be entitled to a fare refund;
2. Should any such person referred to in paragraph 1 refuse to exit the vehicle, the driver or inspector has a right to call the City Guard.
III. Regulations concerning transport of objects and animals:

§ 6

In the vehicles it shall be prohibited to transport:
1. objects of a size larger that stipulated by the Organiser (regarding Operators) or the Carrier;
2. dangerous or venomous animals;
3. flammable, foul-smelling, radioactive, caustic or explosive objects and other dangerous materials;
4. firearms or gas pistols, with the exception of firearms carried by authorised officers on duty;
5. objects that can harm other passengers via damaging or spoiling their body or clothes;
6. animals or objects on a seat.
§ 7

Passengers can transport animals and objects in vehicles, especially according to the following rules:
1. animals and objects excluding those enumerated in § 6, if it is possible to position them in the vehicles in such a way that they do not pose threat to traffic safety, do not obstruct the driver’s vision, do not hamper passage and do not endanger other passengers (e.g. a backpack on the back);
2. transported animals and objects should be accordingly secured, e.g. a dog should wear a muzzle and be kept on a short lead, small animals should be transported in suitable containers, and objects inside packages preventing their spillage or breaking, etc.;
3. the Passenger should have and present at the driver or inspectors’ demand an up-to-date and legally-required certificate of vaccination of the transported animal;
4. transport of an animal or objects can take place only under direct and constant supervision of the Passenger.
§ 8

IV. Final provisions

§ 9

The execution of this Resolution shall be entrusted to the Mayor of the City of Lublin.

§ 10

The Resolution No. 979/XL/2006 of the Lublin City Council of 27 April 2006 on the regulations in the means of communal public transport shall expire.

§ 11

1. This Resolution shall come into force after 14 days of its announcement in the Lubelskie Province Official Gazette.
2. This resolution shall also be published on the websites of the Urban Transport Board in Lublin.
